Use Online Chats In Office, Employees Will Fired

European Court of Human Rights (ECHR) has ruled that the company is allowed to monitor employee Internet activity, including online chats, provided that they have been forewarned that the private use of company resources is prohibited.

Because of this decision has been decided by the ECHR, the highest human rights court in Europe, this decision could affect nearly every country in Europe (except Albania and Kosovo).

This is the result of a case brought by a Romanian engineer, Bogdan Bărbulescu, who was fired for using company accounts Yahoo Messenger to chat with my fiance and his brother.

Bărbulescu took his case to the ECHR because he claims unfair dismissal. He accused her employer's decision to terminate his contract was based on the violation of the right to respect for private life and correspondence and that the Romanian courts have failed to protect their rights.

The engineer argument is that software Yahoo Messenger are by their very nature is designed for personal use and that the nature of instant messaging services has given him the right to expect that it will be a private communication.

However, the ECHR noted in its decision that the normal matter that the internal regulations forbid employees use company computers and resources for personal purposes.

In addition, the Court found that it makes sense for employers who want to ensure that employees are completing their professional duties during working hours.

The fact that employees have been told that he was not allowed to use company resources for personal purposes play a major role in this decision. That means Bărbulescu can not claim human rights violations against the company that oversees what he did.

In addition, the evidence showed that he had actually been using Yahoo Messenger corporate account for personal stuff, breaking the internal rules of the company, which makes a legitimate dismissal.
